Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Anton Zriashchev, an individual developer based in Monterrey, Nuevo León, Mexico ("we," "us," or "our"), governing your use of the Tilt Talk application ("the app"). By downloading or using the app, you agree to these Terms. If you do not agree, do not use the app.

This agreement is between you and us only, not with Apple. Apple is not responsible for the app or its content (see "Apple App Store terms" below).

License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app on Apple devices that you own or control, in accordance with these Terms and with Apple's standard Licensed Application End User License Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms and Apple's standard EULA conflict, these Terms govern to the extent permitted.

Acceptable use and your responsibilities

You agree to use the app lawfully. You are solely responsible for complying with the laws of your location, including laws on recording, wiretapping, and consent to record or translate conversations. In some places all parties to a conversation must consent before it may be recorded or processed. Obtaining any required consent is your responsibility.

Translation is automated and may be wrong

Tilt Talk uses automated speech recognition and machine translation. These technologies make mistakes, especially with idioms, slang, regional vernacular, names, numbers, and noisy environments, and translation output is generally in a standard register rather than a regional dialect. Do not rely on the app where a mistranslation could cause harm — including medical, legal, financial, safety, or emergency situations. The original transcript is shown alongside the translation so both speakers can verify what was actually said. The app is a communication aid, not a substitute for a professional human interpreter.

AI model use restrictions

The app's translation feature uses Google's TranslateGemma model. Your use of that feature is also subject to, and you agree to comply with, the Gemma Terms of Use (ai.google.dev/gemma/terms) and the Gemma Prohibited Use Policy (ai.google.dev/gemma/prohibited_use_policy), which are incorporated into these Terms as enforceable conditions of your use. Among other things, you must not use the app's AI features to generate, facilitate, or carry out unlawful, harmful, abusive, deceptive, or rights-infringing activity as described in those documents.

Subscriptions, free trial, and purchases

Tilt Talk offers paid features through the App Store, which may include auto-renewing subscriptions (for example, monthly and annual plans) and a one-time "lifetime" purchase. The features, the price, and any free-trial length are those shown on the App Store at the time of purchase, and may change; any change applies only to purchases or renewals made after the change.

• Free trial. If a free trial is offered, its length is shown on the App Store. Unless you cancel at least 24 hours before the trial ends, the trial automatically converts to a paid subscription and your Apple Account is charged. Any unused portion of a free trial is forfeited if you purchase a subscription.

• Auto-renewal. An auto-renewing subscription renews automatically for the same period unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the end of the current period.

• Managing and canceling. Payment is charged to your Apple Account. You can manage or cancel your subscription, and turn off auto-renew, in your Apple Account settings on your device. Deleting the app does not cancel a subscription.

• Refunds. Purchases and refunds are handled by Apple under Apple's policies. We do not process payments or issue refunds directly.

• Lifetime purchase. The lifetime option is a one-time, non-consumable purchase. It does not auto-renew and is not a recurring charge.

Apple App Store terms

You acknowledge and agree that: these Terms are between you and us only, not Apple; we, not Apple, are solely responsible for the app and its content; Apple has no obligation to provide maintenance or support for the app; in the event the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (to the maximum extent permitted by law, Apple has no other warranty obligation); we, not Apple, are responsible for addressing any claims relating to the app, including product-liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims arising under consumer-protection or privacy law; in the event of any third-party claim that the app or your use of it infringes that third party's intellectual-property rights, we, not Apple, are responsible for the investigation, defense, settlement, and discharge of such claim; you represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Intellectual property

The app and its original content, features, and design are owned by us and protected by intellectual-property laws. Open-source software and AI models included in the app are licensed under their own terms, which are described in the Open-Source Licenses document available in the app.

Disclaimers

The app is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the maximum extent permitted by law.

Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on a translation. Nothing in these Terms limits any liability that cannot be limited under applicable law.

Mandatory consumer rights

Nothing in these Terms removes or limits any rights you have as a consumer under the mandatory laws of your country of residence that cannot be waived by agreement. Those rights continue to apply.

Termination

We may suspend or end your access to the app if you materially breach these Terms. You may stop using the app at any time.

Governing law and venue

These Terms are governed by the laws of Mexico. Subject to the mandatory consumer rights described above, you agree that the competent courts of the city of Monterrey, Nuevo León, Mexico will have jurisdiction over disputes arising from these Terms or the app, to the extent permitted by applicable law.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the effective date above and, for material changes, provide notice in the app. Continued use of the app after changes take effect means you accept the updated Terms.
